Article 1 – Seller Identification
These Terms and Conditions of Sale ("Terms") are entered into between:
LAUREN VIDAL, a simplified joint-stock company (SAS) registered with the Bobigny Trade and Companies Register under number 389 107 558, having its registered office at Bâtiment B, ZAC de l'Horloge, Chemin Latéral, 93230 Romainville, France,
hereinafter referred to as "LAUREN VIDAL" or the "Seller",
and any natural person acting as a consumer and making a purchase through the website www.laurenvidal.com,
hereinafter referred to as the "Customer".
These Terms exclusively govern the online sale of products marketed by LAUREN VIDAL through its website.
Article 2 – Scope of Application
These Terms apply, without restriction or reservation, to all orders placed through www.laurenvidal.com.
The Customer acknowledges having read and accepted these Terms prior to placing an order. Validation of an order constitutes full and unconditional acceptance of these Terms.
LAUREN VIDAL reserves the right to amend these Terms at any time. The applicable Terms shall be those in force on the date the order is placed.
Article 3 – Products
The products offered for sale are those displayed on the Website at the time of consultation by the Customer, subject to availability.
Each product is accompanied by a description including its essential characteristics, composition, price, available sizes, colours and, where applicable, care instructions.
Product photographs are provided for illustrative purposes only. Minor variations may occur, particularly due to screen settings, dye lots, fabric characteristics or manufacturing processes.
Article 4 – Prices
Prices are displayed in Euros (€), inclusive of all applicable taxes (VAT), excluding shipping costs.
Shipping costs are communicated to the Customer prior to final confirmation of the order and are added to the total order value where delivery is not offered free of charge.
LAUREN VIDAL reserves the right to modify its prices at any time. However, products shall be invoiced on the basis of the prices displayed at the time the order is confirmed.
In the event of a manifest pricing error, including an unreasonably low price resulting from a technical or human error, LAUREN VIDAL reserves the right to cancel the order after informing the Customer.
Article 5 – Orders
The Customer places an order by selecting the desired products, sizes, colours and quantities and adding them to the shopping cart.
Prior to final confirmation, the Customer may review the order details, total price, billing and delivery information and correct any errors.
The order becomes final only upon successful payment authorisation. A confirmation email will then be sent to the Customer.
LAUREN VIDAL reserves the right to refuse or cancel any order in the event of an existing dispute with the Customer, actual or suspected fraud, payment incidents, incomplete or manifestly incorrect information, or any order deemed abnormal.
Article 6 – Payment
Payment must be made online using the payment methods available on the Website at the time of purchase.
Available payment methods may include, without limitation, Carte Bleue, Visa, Mastercard, American Express, PayPal and instalment payment solutions such as Scalapay where available.
All transactions are secured by the payment service providers used by LAUREN VIDAL. Banking details are not stored by LAUREN VIDAL.
If payment authorisation is refused, the order shall not be accepted.
Article 7 – Delivery
Products shall be delivered to the address provided by the Customer during the ordering process.
Delivery options may include home delivery and collection points.
Orders are generally prepared within approximately two (2) business days, to which the applicable carrier transit time is added depending on the selected delivery method.
Delivery times are provided for information purposes only, unless expressly stated otherwise.
In the event of a delay in delivery, Customers shall benefit from the rights granted under applicable consumer protection laws.
Risk of loss or damage to the products transfers to the Customer, or to any third party designated by the Customer, upon physical receipt of the products.
For deliveries outside mainland France, customs duties, import taxes and other local charges may apply and shall remain the sole responsibility of the Customer.
Article 8 – Right of Withdrawal
In accordance with applicable consumer protection legislation, Customers have a minimum statutory withdrawal period of fourteen (14) days from receipt of the products to exercise their right of withdrawal.
LAUREN VIDAL may grant a longer return period where specified on the Website.
Returned products must be complete, unworn, unwashed, undamaged and returned with their original labels, accessories and packaging in a condition suitable for resale.
Products returned incomplete, damaged, stained, worn, washed or otherwise altered shall not be accepted.
Article 9 – Returns, Exchanges and Store Credit
Returns must be requested through the Customer account area or the dedicated online returns portal.
Subject to the applicable return policy:
- Exchanges may be available in certain countries and may involve return and reshipment charges;
- Store credit may be offered under conditions specified on the Website;
- Refund returns may require the Customer to bear return shipping costs except in cases of defective products, preparation errors or non-conforming goods.
The applicable return costs and procedures shall be communicated during the return request process.
Article 10 – Refunds
Where a valid withdrawal request or approved return is made, refunds shall be issued using the same payment method used for the original purchase.
In accordance with applicable law, refunds shall be processed no later than fourteen (14) days from the date on which LAUREN VIDAL is informed of the Customer's decision to withdraw.
However, LAUREN VIDAL may withhold reimbursement until the products have been received back or until proof of return shipment has been provided by the Customer, whichever occurs first.
Unless otherwise required by law, return shipping costs remain the responsibility of the Customer in the case of a standard refund request.
Article 11 – Statutory Warranties
Customers benefit from all mandatory legal warranties available under applicable law, including:
- the legal guarantee of conformity;
- the warranty against hidden defects.
The Seller is liable for any lack of conformity existing at the time the goods are delivered.
